Question: My wife has a ten year green card. She just spent the last 14 months in Thailand during her pregnancy and delivery of our baby. When she tried to return to the US she was denied admission. What can be done to get her back to America?

Answer by U.S. Immigration Legal Advisors in Bangkok Thailand: A green card automatically expires if the Legal Permanent Resident (LPR) remains outside of the USA for a period of one year or more. If the LPR can prove, to the satisfaction of the Embassy, that the reasons requiring the LPR to remain outside of the USA for more than one year were beyond the LPR’s control, the Embassy can allow the LPR to return to the US. Otherwise a new visa must be obtained.
