Answer by U.S. Immigration Legal Advisors in Bangkok Thailand: No, if the petitioner dies before you immigrate to the USA the visa petition is revoked and you will not be issued a visa. If you are able to convince the embassy consular officer that there are compelling humanitarian reasons why you should receive a visa, the consular officer can recommend to USCIS that the visa petition be reinstated.
