Question: My Thai girlfriend and I have a one year old son together. I understand that I can get him a passport at the US Embassy in Bangkok, but can my girlfriend get a visa to the USA based on the fact that her son is a US citizen?

Answer by U.S. Immigration Legal Advisors in Bangkok Thailand: While a US citizen (your son is a US citizen) can petition for an alien parent to live in the USA, the petitioner must be at least 21 years of age and provide evidence that he/she meets the minimum income requirement to sponsor his/her parent or he/she must have a co-sponsor who qualifies.
